Terms and Conditions of the Trail game

ARTICLE 1 – ORGANISATION OF THE GAME

The organising body, the Bourgogne-Franche-Comté Regional Tourisme Committee, a non-profit organisation under the French Act of 1901, whose headquarters is located at 5, Avenue Garibaldi - 21000 DIJON, registered under the SIRET number 820 657 971 00017 (hereinafter known as the "organising body", represented by Mr. Patrick AYACHE, as President.

●        Is organising from 02/11/2021 to 01/12/2021 a free game with no obligation to purchase, entitled "Trail game" (hereinafter known as "the Game"), in accordance with the terms stipulated in the present document..

This game is organised in the form of a prize draw among the participants.

This operation is neither organised, nor sponsored by Facebook, Google, Twitter, Apple or Microsoft.

The personal data collected for the purpose of the present Game is intended for the organising body, not for Facebook, Google, Twitter, Apple or Microsoft.

ARTICLE 2 – CONDITIONS FOR PARTICIPATION

This free Game is open to any physical person over the age of 18, with access to the internet and a valid email address, residing in one of the following countries: Metropolitan France / Overseas France / the rest of the world, with the exception of employees of the organising body and their families, or any person who was involved in creating the Game.

Simply participating in this Game implies acceptance of the present terms and conditions, wholeheartedly, pure and simple.

ARTICLE 3 – TERMS OF PARTICIPATION

This Game is a prize draw-type competition, and only takes place online, via the URL:

on the dates indicated in article 1.

This URL can be accessed from the website "www.montagnes-du-jura.fr", social networks (Facebook, Twitter, Instagram, etc.), and via the company's E-newsletters.

To participate in the Game:

Each person - same email address - can only participate once, for the whole duration of the Game.

The Game is only accessible on the Facebook platform, www.facebook.com, for the moment, and Facebook shall in no case be held liable for any claims related to the Game. Facebook is neither the Game's organiser nor the sponsor. The personal data collected for the purpose of the Game is intended for the organising body, in accordance with article 12 of the present terms and conditions.

The Game is accessible on mobile telephones (Smartphones), but in no event shall Apple, Microsoft, Google or any other mobile application platform be held liable in the event of claims related to the Game.

ARTICLE 4 – DESIGNATION OF THE WINNER

1 winner shall be picked at random after the end date of the Game, mentioned in article 1, within a period of 15 days.

A winner will be chosen at random from the participants who filled in and validated the participation form.

The winner will be contacted directly by email, by the Bourgogne-Franche-Comté Tourism Regional Committee, within 15 days of the prize draw, and will be asked for a postal address to be able to send their prize.

ARTICLE 5 – PRIZE

The following prize can be won by the participant chosen at random and declared the winner.

Description of the prize:

●      An afternoon's training session with Xavier Thévenard, on the date agreed between the organising body and the service provider. This date will be notified to the winner when he/she is contacted following the prize draw.

The organising body reserves the right to verify the age of the winner before issuing the prize. Prizes can in no case be exchanged for a cash amount or any other prize. The organising body shall not be held responsible for the use or lack of use, or even the trade, of prizes by the winner.

In the event of force majeure, the organising body reserves the right to cancel the issuance of the prize won, without compensation.

ARTICLE 6 – IDENTIFICATION OF PARTICIPANTS AND REFUSAL OF PARTICIPATION

Participants authorise a verification of their identity and of any information they provide on the participation form. If the participation form is not complete and/or includes incomplete or false information, this participant shall not be considered for the Game and shall be eliminated.

Likewise, non-compliance with the present terms and conditions, or any fraud or cheating, of any kind whatsoever, shall result in the elimination of the participant, pure and simple.

ARTICLE 7 – MODIFICATION OF THE GAME DATES AND INCREASE IN THE NUMBER OF PRIZES

The organising body shall not be held liable in the event of force majeure, or any events that are out of their control, that result in cancelling the present Game. They reserve the right to extend or limit the participation deadline, postpone it or change the conditions, and shall not be held liable as a consequence.

Any additions or modifications to these terms and conditions may be published during the Game. They will be considered appendices to the present terms and conditions. Participants will be informed of any changes by any appropriate means.

ARTICLE 8 – USE OF PARTICIPANTS' IDENTITY

Your personal data is processed by the Organising Body, acting as the recipient and controller of data processing, in accordance with application French and European regulations with regards Data Protection.

In filling in the required form to participate in our game, you give your consent for us to process and collect your personal data. The personal data collected is compulsory. If you do not provide the required data, you will not be able to participate in the game.

This data is strictly intended only for the Organising Body, for the sole purpose of taking into account your participation in the game, for managing participants, awarding prizes and to satisfy legal and regulatory requirements. Your data may also be used for commercial prospecting purposes, with your consent.

Your personal data is transferred to our marketing and communication departments, as well as service providers and subcontractors that the Organising Body may have called upon for any needs regarding the organisation and/or management of the game. These subcontractors are located in the European Union.

Your personal data shall be deleted immediately after the end of the game, or shall be stored for a maximum period of 3 years if you give your consent for this data to be used for commercial prospecting purposes. This period could be extended in the event of a risk of litigation, so we can defend our interests.

You can withdraw your consent at any time.

You have the right to access, rectify, remove and the right of portability regarding your own personal data, to limit and oppose the processing of your data, and the right to define how your personal data shall be used after your death. To exercise these rights, please send a request to info@bfctourisme.com. You also have the right to send a claim to the French Data Protection Authority (CNIL). 

ARTICLE 9 – REFUND OF PARTICIPATION FEES

Given that as part of current service and technical offers, certain internet access providers offer free connection or package deals to internet users, it is expressly agreed that access to the website is on a free or package deal basis (such as cable, broadband or any other special link) and shall not result in any form of refund, since the internet user already has a subscription to an internet provider to be able to use the internet in general, and choosing to connect to the website and participate in the Game does not result in any extra cost or disbursement.

ARTICLE 10 - RESPONSIBILITIES

Participation implies knowledge and acceptance of the characteristics and limits of the Internet, the absence of protection for certain data against possible misuse or hacking, and the risks of contamination from possible internet viruses. The organising body declines all responsibility, direct or indirect, for damages of any kind caused by the incorrect use of the computer, internet access, maintenance or by any faults on the Game servers, the telephone line or due to any other technical connection, or in sending the forms to a wrong or incomplete address.

All participants must take the appropriate measures to protect their own data and/or software programs stored on their IT equipment, from any risk.

The organising body will do its utmost to allow access to the Game. The organising body could, at any moment, for example for technical reasons, updates, or maintenance, interrupt access to the website and to the Game. The organising body shall in no case be held responsible for these interruptions and any consequences thereof. No compensation shall be issued as a result.

The organising body shall also not be held responsible in the event of delivery problems or lost post or emails (this also applies to the delivery of prizes). Any prize sent to a winner by the organising body, that is not claimed or returned for any other reason by the postal services shall be deemed lost by the winner and the property of the organising body. The organising body shall not be held liable in the event of a bad internet connection, or for any delays, loss or damage caused by postal services and management.

ARTICLE 11 – INTELLECTUAL PROPERTY RIGHTS, LITERARY AND ARTISTIC RIGHTS

The images used on the Game website, as well as the objects displayed, the brands and trade names mentioned, graphics, IT tools and databases featured on the Game website are all sole property of their respective owners and cannot be extracted, reproduced or used without written consent from the latter, otherwise this could give rise to civil and/or criminal proceedings.

ARTICLE 12 – PERSONAL DATA

The organising body processes personal data for the purpose of managing the Game. The organising body is in charge of processing the personal data collected.

The personal data collected is only used for organising the Game. If the participant has chosen so by ticking the box at the bottom of the questionnaire, his/her email address will be used to send him/her the newsletter. The data collected is stored until the winner has been chosen, then the data is removed, unless the participant has given his/her consent for it to be kept for commercial prospecting purposes, in which case it will be stored for a maximum period of 3 years after the last contact (prospect) or reservation (customer).

The participants are informed that in accessing the Game website, cookies may be stored on the hard drive of their computer. This is a small computer file that stores browsing information from the Game website. Cookies are used to be able to identify each participant so that he/she can access the information more quickly, without having to enter details again. These cookies do not, in any case, damage the data stored on the computer.

A participant can choose to block these cookies, or choose to be notified when a cookie will be stored on the hard drive, in the browser settings (the participant is invited to check the browser's terms and conditions of use regarding this feature). In the event these settings have been changed, the participant can still access the Game website and participate in the competition.

In accordance with the Data Protection and Civil Liberties Act of the 6 January 1978, amended, and European Regulation 2016/679 of 27 April 2016 with regards the protection of physical people concerning the processing of personal data, you have the right to access and rectify any of your own personal data, as well as the right to oppose, the right to limit processing and to remove your data, as per European Regulation.

If after contacting the organising body, the participant considers that his/her rights in terms of personal data have not been respected, he/she can issue a claim with the CNIL.

ARTICLE 13 – ATTRIBUTION OF COMPETENCE AND INTERPRETATION OF REGULATIONS

Any dispute regarding the interpretation of the regulations shall be dealt with by the organising body.

In participating in this Game, you accept the following, wholeheartedly:

No telephone or written request about the interpretation or application of the present terms and conditions, the tools and rules of the Game, or about the identity of the winner shall be answered. In the event of a dispute, the only mode of communication shall be a registered letter with acknowledgement of receipt, sent within 30 days of the end date of the Game. Except in the case of manifest errors, it is agreed that the information from the organising body's Games systems shall be deemed conclusive in any dispute regarding the connection and computer processing of said information within the context of the Game.

Prior to any legal action regarding the present terms and conditions (particularly due to the application or interpretation of said conditions), the participants agree to seek an amicable agreement with the organising body.

Participants are subject to French regulations applicable to Games and competitions. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of the organising body's headquarters, unless stated otherwise.
